Welcome! These Terms of Service (together with our Privacy Policy, the “Terms” or “Agreement”) form a legally binding contract between you (“you” or “your”) and VittaWell (“Company,” “we,” “our,” or “us”). They govern your use of our websites, mobile applications where these Terms appear, and any purchases made from us (collectively referred to as the “Service”).

By using or accessing the Service, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

1. VittaWell VIP Membership & Subscription Terms

1.1 Overview

Our optional VittaWell VIP Membership ("Membership") offers access to discounted pricing, exclusive promotions, a price-match guarantee, and free standard shipping, as detailed during sign-up.

Price-Match Guarantee: We will match any public U.S. online retailer’s price for an identical product (same brand, model, size, and color) within 14 days of your purchase. Valid proof of the lower price is required. Exclusions may apply (e.g., flash sales, auction platforms, clearance). Contact us for verification before submitting a request.

Membership pricing and perks may change over time, but we’ll always give reasonable prior notice before any fee increases, allowing you the opportunity to cancel.


1.2 Free Trial & Opt-In

The Membership is not selected by default during checkout — you must choose it manually.
Your 14-day free trial begins with no charge, but valid payment information is required.
Unless cancelled before the trial ends, your payment method will be charged as described below.


1.3 Billing & Automatic Renewal

Once your free trial ends, we will charge $29.99 USD (plus applicable taxes) to the payment method on file. Your Membership will automatically renew every 30 days unless cancelled.

You will receive a confirmation email summarizing the subscription terms and cancellation instructions.


1.4 Cancelling Your Membership

If you wish to cancel your VittaWell VIP Membership, you may do so at any time by:

  • Filling out the cancellation form on our website

  • Emailing help@vittawell.com at least 3 days before your next billing cycle
    (Be sure to include your full name, email address, and physical address associated with your account.)

Failure to cancel or continued use of the Membership will be considered confirmation that you're authorizing the charges and accepting the terms.


1.5 Payment Methods

By entering payment information (e.g., credit card, PayPal, Google Pay), you confirm you’re authorized to use that method and authorize us—and our processors—to charge the full amount due. We reserve the right to correct billing errors at any time.


1.6 Refunds

Physical products may be returned or exchanged within 30 days of delivery, provided they are in original condition and packaging, and accompanied by proof of purchase.

Membership fees are non-refundable, unless required by law or stated otherwise at checkout.

If your item is defective or incorrect, please contact help@vittawell.com and we’ll resolve the issue quickly.

Return or refund approvals do not alter or waive any portion of these Terms.


2. Dispute Resolution

2.1 Governing Law & Venue

These Terms are governed by the laws of Nevada (USA). Subject to the arbitration clause below, any legal disputes must be resolved in the state or federal courts located in Nevada.


2.2 Arbitration Clause

If a dispute cannot be resolved informally, it must be settled through binding arbitration under the U.S. Federal Arbitration Act and JAMS Streamlined Arbitration Rules. Arbitration may occur in person, by video, or phone. Each party is responsible for its own legal fees unless otherwise required by law.


2.3 No Class Actions

Claims may only be pursued individually. You may not participate as a plaintiff or member in any class, consolidated, or representative legal action.


3. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED “AS IS.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES (EXPRESS OR IMPLIED). OUR LIABILITY IS LIMITED TO $100 USD OR THE AMOUNT YOU PAID (WHICHEVER IS GREATER) FOR DIRECT DAMAGES ONLY. WE ARE NOT LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES.


4. Assumption of Risk

You use the Service and all related content/products at your own risk. By doing so, you agree to release VittaWell and its affiliates from any liability, to the fullest extent allowed by law.


5. Modification & Termination

We may update these Terms at any time by posting an updated version. Continued use of the Service implies acceptance of those changes.
We reserve the right to suspend or terminate your account if these Terms or laws are violated. Sections 2–5 and 8–9 survive any termination.


6. Acceptable Use

You must be at least 18 years old (or the age of majority in your region) to use the Service.
You agree to provide accurate information and refrain from misuse (e.g., reselling, scraping, or reverse engineering).
You also agree to defend and hold VittaWell harmless from third-party claims arising from your misuse of the Service.


7. Third-Party Services

We may include links to third-party sites or services for your convenience. These are not under our control, and we are not responsible for their content or use.


8. Intellectual Property

All visuals, logos, product designs, and content are the intellectual property of VittaWell or its licensors. No rights are granted except as explicitly outlined in these Terms.


9. General Provisions

These Terms represent the full agreement between you and VittaWell. If any part is unenforceable, the rest remains valid. We may assign our rights under these Terms; you may not assign yours without written consent. Delays caused by force majeure events do not constitute breach.
